These Terms of Service ("Terms") govern your access to and use of the website at alternativeoptions.insure (the "Site"), operated by Alternative Options Insurance Agency ("Alternative Options," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Alternative Options Insurance Agency is a California-licensed property and casualty insurance agency (CA License 6017795) located at 1420 Gorgen Lane, Upland, CA 91784. We provide insurance brokerage, PEO consulting, and risk management services to employers.
The information on this Site is provided for general informational and educational purposes only. It is not insurance, legal, tax, accounting, or financial advice. Nothing on this Site creates an agent-client, attorney-client, fiduciary, or advisory relationship between you and Alternative Options. A client relationship is established only through a separate written agreement after we have collected the information necessary to advise you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTERNATIVE OPTIONS, ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).
You agree to defend, indemnify, and hold harmless Alternative Options and its owners, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys fees) arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in San Bernardino County, California, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. When we do, we will revise the Effective Date above. Material changes will be posted on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Alternative Options regarding your use of the Site, and supersede any prior agreements or understandings on that subject.
Alternative Options Insurance Agency may send SMS text messages to individuals who affirmatively opt in. By providing your mobile phone number and checking the opt-in checkbox on our website form or explicitly consenting through another approved method, you agree to receive recurring SMS text messages from Alternative Options Insurance Agency.
We will retain documentation of your opt-in consent, including the date, time, method of consent, and the specific consent language you agreed to, in accordance with carrier regulations and TCPA requirements.
Important: Your consent to receive text messages is not a condition of purchasing any product or service from Alternative Options Insurance Agency.

Message frequency varies depending on your interaction with us. Under normal circumstances, you can expect between 1–5 messages per month. During active consultations or policy renewals, frequency may temporarily increase. Your level of engagement directly affects message frequency.
Message and data rates may apply based on your mobile carrier's plan. Standard text message rates will apply. We are not responsible for any charges imposed by your carrier. Check with your carrier for details about your plan's text messaging rates.
You may opt out of receiving text messages at any time by:
Upon receipt of your opt-out request, we will remove your phone number from our active messaging list within 24 hours. You will receive a final confirmation text message confirming your opt-out. We will retain documentation of your opt-out request in accordance with carrier regulations and TCPA requirements.
Alternative Options Insurance Agency complies with the Telephone Consumer Protection Act (TCPA), all FCC regulations, and the specific SMS/A2P messaging guidelines and requirements of all major wireless carriers, including Verizon, AT&T, T-Mobile, US Cellular, and others.
We maintain records demonstrating our TCPA and carrier compliance, including documented opt-in consent, message frequency monitoring, opt-out processing, and complaint handling procedures.
Wireless carriers are not liable for any delayed, undelivered, or misdirected text messages. Alternative Options Insurance Agency makes reasonable efforts to ensure timely delivery, but cannot guarantee message delivery in all cases due to factors beyond our control.
You must be 18 years of age or older to use this SMS service. By opting in, you represent and warrant that you are at least 18 years old. If you are providing a phone number on behalf of your business, you represent that you have the authority to provide that number and to consent to text messages on that behalf.
No mobile phone numbers, SMS opt-in data, text message consent records, or message content will be sold, rented, shared, or disclosed to third parties or affiliates for marketing or promotional purposes.
Information sharing to service providers (such as messaging platform administrators, technology support, or customer service representatives) is permitted only as necessary to support our communications with you and to maintain compliance with applicable legal and regulatory requirements.
Text messaging originator opt-in data, consent records, and SMS communication logs will not be shared with any third parties except as required by law, court order, or to comply with FCC, TCPA, or carrier regulations.
We retain all SMS opt-in records, consent documentation, message logs, and opt-out records in accordance with TCPA requirements, carrier regulations, and our legal obligations. Opt-in records are retained for at least the duration of your consent and for a reasonable period thereafter to defend against disputes. Opt-out records are retained for a minimum of one year after your opt-out date to demonstrate compliance with your request and TCPA requirements.

These SMS/Text Messaging Terms are governed by the laws of the State of California and the Telephone Consumer Protection Act. Any disputes related to our SMS program will be subject to the same governing law and jurisdiction provisions set forth in Section 11 of these Terms of Service.
Your use of our SMS/text messaging program is also governed by our Privacy Policy. In the event of any conflict between these SMS Terms and our Privacy Policy, the more restrictive provision will apply.
